Building a Temporary Dwelling Structure for Individual Property Owners

What is a Temporary Structure?

A temporary structure is a dwelling unit permitted for 180 days. Examples include but are not limited to RV, pre-fabricated living space for temporary habitation, trailers, modular homes, constructed or enclosed areas used for temporary habitation.

To be considered for a temporary permit, dwelling units must meet Maui County Fire Code and must not pose a life safety or fire safety hazard. Units must be supported with certified individual wastewater systems or County sewer service to protect public health and sanitation.

Steps to Apply for a Temporary Permit within Lahaina Fire Impacted Areas

Prepare a Site Plan

For a site plan you'll need the following:

  • Tax map key parcel number shall clearly indicated on site plan along with property address.
  • Property Owner’s name and mailing address.
  • Applicant’s name and mailing address.
  • All temporary dwelling units. Each unit shall be numbered and labeled with the number of bedrooms.
  • All other proposed structures.
  • All other existing structures.
  • Existing roads (label with name) and driveways.
  • Proposed roads and driveways (label distance and width).
  • All proposed utility installations (water, sewer, electrical, cable, etc.) that requires trench excavation.
  • Location of nearest existing fire hydrant with approximate distance from farthest proposed dwelling.
  • Location of proposed fire hydrants.
  • Distance between proposed building and adjacent structures.
  • Total area of temporary housing including proposed roads.
  • Completed site plan shall be drawn to scale and all features shall be labeled and uploaded to MAPPS when applying for the temporary building permit.
Prepare Land Owner Authorization
Determine total value of temporary structure.
  • Determine the total value of all temporary dwellings (“Valuation”) that includes the value of all materials and labor for each dwelling unit, regardless if the materials or labor are donated.
  • A single temporary building permit application is used for all dwelling units on a parcel.
Complete the Design Professional/Electrical/Plumbing Certification Form

3. Create a MAPPS Customer Self Service account

4. Submit application online in MAPPS

5. Pay Fees

  • DSA Building Plan Review Fee is waived since a building plan review is not conducted for temporary building permits.
  • DSA Building Permit Fee is required to be paid prior to issuance of building permit, if approved by all agencies.
  • Fire Department Plan Review Fee is required to be paid before a temporary building permit application is routed to agencies for review.

6. Receive Approval

  • Once you receive approval, you can proceed with your plans for your temporary structure.

Temporary Building Permit for Dwellings for Displaced Wildfire Survivors

Temporary building permits for dwellings units are issued pursuant to Ordinance 5507, Section 108 Temporary Structures and Uses and the Mayor's Emergency Proclamation Relating to Wildfires

  • The temporary structure permit is initially granted for 180 days, with extensions to be granted provided the Mayor's Emergency Proclamation is in effect and compliance with the permit requirements is maintained.
  • All temporary structures permitted under the Mayor's Proclamation shall terminate all use within 120 days and be removed within 180 calendar days of the end of the Proclamation.

Temporary building permit applications must be submitted to the Maui’s Automated Planning and Permit System (MAPPS).

Can I apply now to construct or place a temporary dwelling unit on my parcel outside of the fire burned area?

A temporary building permit application for a temporary dwelling unit outside the fire burned area will be accepted. Please go to the “How to apply for a permit” for more information.

Can I apply now to construct or place a temporary dwelling unit on my parcel inside the fire burned area?

A temporary building permit application for a temporary dwelling unit inside the fire burned area will be accepted; however the permit application will not be routed to agencies for review until the County confirms the parcel has completed fire debris removal. Please go to the “How to apply for a permit” for more information.

How long will it take to obtain a temporary building permit if my parcel is inside the fire burned area?

If there are no more than a total of 3 dwelling units on the property and the units will be connected to the County Water and County Sewer, the review time should be approximately 2-3 weeks; however the permit application will not be routed to agencies for review until the County confirms the parcel has completed fire debris removal.

If there are more than a total of 3 dwelling units on the property or the units will not be connected to County Water and County Sewer, the review time may take longer.

How long will it take to obtain a temporary building permit if my parcel is outside the fire burned area?
